Terms of service

These terms govern your use of brisalva.com and any order you place through it. By placing an order you accept them. Please read them — they are short and written in plain English on purpose.

1. Who you are buying from

Brisalva is an online shop. Our business is domiciled in Ecuador and we sell to customers in the United States. We are not a company registered in the United States, and orders are dispatched from our supplier's warehouse. We would rather you knew this before you ordered than after.

The only contact address for the business is support@brisalva.com.

2. Who can order

You must be at least 18 years old and able to enter into a binding contract, and your delivery address must be within the 50 United States.

3. Products and how we describe them

We describe our products as accurately as we can. Photographs and swatches are shown for illustration: screens vary, lighting varies, and skin varies, so the colour you see on your device may not be an exact reproduction of the colour on your face. Cosmetic products may also differ slightly between production batches.

We do not make medical or dermatological claims. Our products are cosmetics. They are not intended to diagnose, treat, cure or prevent any condition.

4. Using cosmetic products safely

• Patch test on the inside of your arm before the first full use.
• Avoid contact with the eyes. If the product gets into your eyes, rinse with plenty of water.
• Do not use on broken, irritated or sunburnt skin.
• Stop using the product if irritation occurs.
• Keep out of reach of children. Store away from direct heat and sunlight.

If you have a known sensitivity to cosmetics, or you are unsure whether a product suits you, speak to a qualified professional before using it. We cannot give you skin advice and we will not pretend to.

5. Prices and payment

All prices are in US dollars (USD). Shipping is free. We may change prices at any time, but never after you have placed an order.

We currently accept PayPal only. Shopify Payments is not available to businesses in Ecuador, which is why you will not see card fields at checkout. PayPal lets you pay with a card without holding a PayPal account.

6. Orders

Your order is an offer to buy. The contract is formed when we send you a confirmation email. We may refuse or cancel an order — for example if the item is unavailable, if there was a pricing error, or if we suspect fraud — and if we do, we refund you in full.

7. Delivery

Shipping is free to the 50 United States and takes 8 to 15 business days after dispatch. Full detail is in our Shipping Policy, which forms part of these terms.

8. Refunds

You have 30 days from delivery to request a refund, and you do not have to send the product back. Full detail is in our Refund Policy, which forms part of these terms.

9. Your information and your conduct

You are responsible for the accuracy of the information you give us, including your delivery address. You agree not to use this site for anything unlawful, and not to interfere with its operation.

10. Intellectual property

The Brisalva name, logo, site text, layout and photography are ours or are used with permission. You may not copy or reuse them commercially without our written consent.

11. Reviews shown on this site

Where we show reviews that were published elsewhere — for example on a manufacturer's or marketplace listing for the same product — we say so next to them. We do not write reviews ourselves and we do not present other people's words as our own customers'.

12. Limitation of liability

To the fullest extent permitted by law, our liability in connection with any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss. Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

13. Governing law

These terms are governed by the laws of the Republic of Ecuador, where our business is domiciled. This does not deprive you of the protection of the mandatory consumer protection rules of the US state where you live, and you may bring proceedings in your local courts where the law gives you that right.

14. Changes

We may update these terms. The version that applies to your order is the one published on this page at the time you ordered.
